How Long Do I Have to File a Personal Injury Claim in Texas?
Injury victims have a time limit on how long they have to file a personal injury claim before they lose their legal right to do so. The law that sets this time limit is called the statute of limitations. According to the Texas Civil Practice & Remedies Code section 16.003, the statute of limitations for personal injury cases in the state of Texas is two years.
More specifically, this means you have two years from the date your injury occurred to file your claim, or you will lose your right to file which essentially means losing your right to recover compensation. It’s important to note that there are exceptions that can lengthen or shorten this time limit. The most notable exceptions include:
- If the injury victim was a minor at the time of the accident the statute of limitations will typically be extended
- Similar to cases where the injury victims is a minor, the statute of limitations is typically extended for those with a legal mental disability
- If the alleged negligent party leaves the state of Texas before a claim can be filed
